HARMONY WHISTLER VACATIONS BOOKING POLICIES / TERMS & CONDITIONS

PAYMENT & CANCELLATIONS

Our policy was updated on May 25, 2020, bookings made on or after this date will fall under the new policy.  For reservations made after this date, the cancellation policy agreed to at the time of booking will remain in place.  These policies are both outlined below.

New Policy for Bookings made on or after May 25, 2020: 

At the time of booking, a deposit of 25% plus tax will be required to complete your reservation. We accept Visa and Mastercard. This credit card will be billed automatically for any unpaid balance on the date the full payment is due, unless you discuss alternative payment arrangements.

The balance of your stay is automatically charged 30 days prior to your arrival. For bookings made within 30 days of arrival, the full amount will be charged when the booking is made.

Bookings canceled at least 30 days before the start of the stay will receive a full refund. Bookings canceled at least 14 days before the start of the stay will receive a 50% refund.

The guests shall not let / sublet all or any part of the Premises nor assign this agreement without prior written consent.

Harmony Whistler encourages guests to purchase 3rd party cancellation insurance to avoid fees in the event of a cancellation needing to be made.

Non Canadian Guests, please note that some credit card companies may charge you a padded exchange rate or a foreign transactions fee.

Harmony Whistler Vacations cannot issue refunds based on weather conditions.

Policy for Bookings made on May 24th or Earlier: 

At the time of booking, a non-refundable deposit of 25% plus tax will be required to complete your reservation. We accept Visa and Mastercard. The balance of your stay is automatically charged 45 days prior to your arrival. For bookings made within 45 days of arrival, the full amount will be charged when the booking is made and is non-refundable.

The guests shall not let / sublet all or any part of the Premises nor assign this agreement without prior written consent.

Harmony Whistler encourages guests to purchase 3rd party cancellation insurance to avoid fees in the event of a cancellation needing to be made.

CHECK-IN / OUT

The check-in procedures will be confirmed via. email once the booking is made. The majority of our properties have door codes which will be issued to you for the dates of your stay.

All properties will be ready for check-in by 4:00pm. If you wish to check-in earlier, please let us know. We will do our best to make it happen.

Security Deposit
Prior to check-in, guests will be required to provide a credit card for a pre-authorization for a security deposit plus photo identification. The amount of the deposit varies depending on the unit and will range between $500 and $2,000.  The specified amount will be in the property description and confirmed in a Booking Confirmation.  The pre-authorization will be released after check out and will only be charged up to the pre-authorized amount after departure if property is damaged, requires excessive cleaning, or if items are missing. The maximum amount charged will be the specified amount.  The credit card provided must be in the name of the main guest, no third party credit cards will be accepted.

If the cleaners are unable to access the property after 10 am to clean, they may charge a turn away fee, which will be deducted from your security deposit to cover the costs of their teams time.

Damages
Guests are expected to notify Harmony Whistler immediately upon arrival of any damage to the unit is noticed. The guest accepts the Premises in its present condition and agrees to take good care of the Premises during their stay and further agrees to pay all costs to replace or repair any property damaged by the guest during their stay.

Minimum Age
Guests must meet our minimum age requirement for the unit booked and must provide ID at check-in, unless prior approval has been given.  The minimum age varies depending on the unit and will be 25, 30 or 35.  The minimum age requirement will be specified in the description for each unit.  No groups and all guests must meet the minimum age requirement, unless prior approval has been given.  Harmony Whistler retains the right to refuse access to any property if this condition has not been met and no refund will be provided.

Housekeeping
The property will be clean and ready for your arrival. Daily housekeeping is available for an extra fee. For stays of ten days or more, there will be a midweek clean if requested. It is important to request this 7 days prior to arrival as the cleaners may not be able to accommodate if requested upon arrival. All properties have laundry facilities either in the unit or in the building. Adequate quantities of towels / linens will be provided for the number of people booked.

Parking
Most properties have a specified parking stall for one vehicle, unless otherwise stated (exceptions include Glacier Lodge, The Aspens, The Marquise). There is visitor parking at most complexes, on a first come, first served basis. If your vehicle is over sized, it can be difficult to accommodate in Whistler and parking for such vehicles may not be available at peak times. Please contact Harmony Whistler to discuss options. Parking instructions will be given with check-in details.

Buses in Whistler:
The free public shuttle is operated by BC transit and we are not responsible for the schedule or any strikes which may impact service. Harmony Whistler Vacations cannot provide refunds or compensation based on public transportation issues.

Private Hot Tubs:
Harmony Whistler Vacations ensures that all private hot tubs are maintained regularly. Guests use hot tubs at their own risk.

Communal Hot Tubs:
The strata management company for the complex maintains communal hot tubs. Occasionally, hot tubs may close due to maintenance or health & safety. Harmony Whistler Vacations is not responsible for shut downs and cannot provide compensation for such events.

Smoking
All properties and complexes are entirely non-smoking this includes but is not limited to smoking cigarettes/marijuana and vaping. This includes all patios, balconies and common areas. Please limit smoking to outside of the complex, where permissible. Please do not dispose of butts in or around the complex and specifically over railings as this is considered a fire hazard. Any units with evidence of smoking in the complex, including tampering or covering the smoke detectors, will result in a $500 fine from Harmony Whistler and may also result in complex and municipality fines.

Pets
Pets of any kind are not permitted in any of our properties unless agreed to in advance. Please contact Harmony Whistler for further information. There will be a $500 fine for any pets or evidence of pets found in the units, if permission has not been granted.

There are a select few properties that are pet friendly, please refer to the listing description for more information.  Pet friendly properties can be sorted in the drop down menu at the top of our Properties web page. 

Noise
Excessive noise will not be tolerated at any time of the day. Security and Strata has the option to evict and / or fine guests. Quiet hours are 10pm to 8am which includes use of the hot tub and common areas, if applicable.

Maximum Occupancy

1 bedroom – 2 occupants standard (4 occupants if sofa bed is provided & approval given. $25 fee per person, per night)

2 bedroom – 4 occupants standard (6 occupants if sofa bed is provided & approval given. $25 fee per person, per night)

3 bedroom - 6 occupants standard (8 occupants if sofa bed is provided & approval given. $25 fee per person, per night)

4 bedroom - 8 occupants standard (10 occupants if sofa bed is provided & approval given. $25 fee per person, per night)

 

Any occupants that exceed the Standard Occupancy limitation are subject to a $25.00 per person, per night. Any occupants that exceed the Maximum Occupancy will be evicted without refund.


Liability Disclaimer

Prices for Accommodation and packages are subject to change without notice, and reservations are based on availability. Bookings and prices are not confirmed until a non-refundable deposit has been received and confirmation email has been sent to Guest.

 

The Owner / Harmony Whistler shall not be liable to the guest for any injury or damage to person or property in or about the Premises by or from any cause whatsoever.

 

Each unit is privately owned and subject to availability. Due to unforeseen circumstances, should the reserved unit no longer be available for rental, Harmony Whistler reserves the right to relocate the guests.  Every effort will be made to relocate to another unit of equivalent or superior quality, this cannot be guaranteed and is subject to availability. 


Termination
Failure by the Guest to meet the payment terms and schedule may result in termination and forfeiture of deposits.

COVID
TRAVELLING DURING COVID 
It is the guests responsibility to adhere to all government requirements for travelling during Covid.  For guests travelling from outside of Canada, requirements for entry into Canada can be found on our government’s website HERE.  The guest’s country of residence may also have requirements for re-entry and we recommend checking your government’s requirements for re-entry.  Due to the everchanging situation of Covid, we recommend following these requirements prior to, during and after your stay.  Harmony Whistler Vacations will not provide any refunds for guests that are unbale to enter into Canada due to not meeting government requirements for travel due to Covid. 

DURING YOUR STAY
Guests will follow all public health advisories during their stay with Harmony Whistler Vacations. 

Lost Property 
Lost property including valuable items left behind by the Tenant or the Tenants Guests will be held for the Tenant for up to 1 month, after which they shall become the Property of the Landlord. The Landlord shall not be held liable for the condition of said items. The Tenant is responsible for any cost associated with the storage or return of said items plus a small admin fee to cover our time and shipping supplies. 


7162 Nancy Greene Drive Booking Policies
Please note that 7162 Nancy Greene Drive has a separate set of Booking Policies due to the size of the home.
We ask all guests to sign a Short Term Lease Agreement prior to arrival. The terms are listed below.

Rental period begins at: 5pm on the check-in date

Rental period ends at: 10am on the check-out date
 
Terms of the Agreement:
  1. The Tenant and Tenant guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or personal Property damage or loss arising from use of the Property, regardless of the nature of the accident, injury or loss. The Tenant expressly recognizes that any insurance for Property damage or loss which the Landlord may maintain on the Property does not cover the personal Property of Tenant, and that Tenant should purchase their own insurance for the Tenant and Guests, if such coverage is desired.
  2. The tenant and Tenant guests agree that every individual using the Bike Equipment must carefully read and sign the Bike Liability Waiver and Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement form provided by Harmony Whistler Vacations prior to the use of the Bike Equipment.
  3. The Tenant and Tenant guests shall maintain the Property in clean condition, and use the Property only in a careful and lawful manner. The Tenant shall pay for repairs should the Property be left in a lesser condition. The Tenant agrees that the Landlord shall deduct costs of said services from their Damage Deposit if the Tenant and/or Tenant guests cause damage to the Property or its furnishings. If the Damage Deposit is insufficient, the Tenant agrees to pay the excess by credit card, or other method if agreed by the Landlord, within 48hrs of request.
  4. The Tenant and Tenant guests shall use the Property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harbouring fugitives, etc.; shall cause termination of this Agreement with no refund of rents or deposits. 
  5. The Landlord has the right to inspect the Property at any time, without prior notice, to enforce the terms of this agreement. Should the Tenant and Tenant guests violate any of the terms of this agreement, the Rental Period can be terminated immediately. The Tenant waives all rights to process if they, or their Guests, fail to vacate the Property upon termination of the Rental Period. The Tenant and Tenant’s Guests shall vacate the Property at the expiration time and date of this agreement.
  6. If the Tenant violates any of the terms of this agreement, yet wishes to remain in the Property until the end of the Rental Period, the Landlord & Tenant may negotiate an additional Damage Deposit amount. This is subject to the Landlord’s approval & a full inspection of the Property.
  7. The Tenant agrees to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by the Landlord enforcing this agreement.
  8. If the Tenant wishes to pursue legal action against the Landlord, it must occur under the jurisdiction of British Columbia, Canada.
  9. The Tenant expressly acknowledges and agrees that this Agreement is for transient occupancy of the Property, and that The Tenant shall not make the Property a residence or household.
  10. There shall be no refunds due to cancelled stays, shortened stays or ruined expectations because of weather conditions, acts of nature, disease outbreaks, acts of civil authorities, acts of war or terrorism, or other force majeure.
  11. We advise that the Tenant and their guests purchase travel insurance to cover them in case of any issues out of their control.
  12. All payments made for accommodation are non-refundable and non-transferable, beyond the Cancellation Period listed on the Tenants Invoice.
  13. All Rates and Deposits are quoted and returned in Canadian Dollars. The Landlord is not responsible for any currency fluctuations resulting in a change in the value of and money being returned to the Tenant. 
  14. The Tenant shall not sublet the Property. The Tenant is considered to be the Lead Guest and must be staying at the Property, unless agreed otherwise in advance.
  15. The Tenant agrees to adhere to the check-in and check-out time policy as follows.  Check-out time is 10:00 am and there is unfortunately NO flexibility on this. If the Landlord's cleaning team is unable to have undisturbed access to the Property at 10:00 am, then this will result in a turnaway fee of $500 plus tax, which will be deducted from the Damage Deposit to cover the costs of the team’s time.  Check-in time is 5:00 pm, should the Tenant wish to submit an early check-in request, then this can be done after booking.   Guaranteed check-in time is 5:00 pm, however, should a request be submitted then the Landlord will do everything that they can to accommodate this but it cannot be guaranteed.  The Landlord's priority is to ensure that all Tenant's are able to enjoy the home for the timeframe that they have booked.
  16. The Tenant shall have no more than 16 persons present on the Property at any given time. If the Tenant wishes to have more than 16 persons on the Property they may apply for an exception from the Landlord before confirming the booking, or with as much notice as possible. If the Landlord is able to permit more than 16 persons on the Property, a written exception will be provided for the Tenants records. 
  17. The Tenant will allow a maximum of 8 vehicles to be parked at the Property. The Tenant will not permit any members of their group to park on the street in the neighbourhood.
  18. The Tenant will not permit any camping on the Property. The Tenant will not park any RVs on the Property.
  19. The Tenant and Tenant guests shall behave in a civilized manner and shall be good neighbours, respecting the rights of the surrounding Property owners. The Tenant and guests shall not create noise or disturbances likely to disturb or annoy the surrounding Property owners. Outdoor noise should be kept to a minimum at all times.
  20. The Community Bylaws indicate that there should be no noise audible outside the Property from 10 PM to 8 AM. Failure to adhere to this Bylaw shall be grounds for termination of the Rental Period and the Tenant and Tenant’s guests may be required to immediately vacate the Property.
  21. It is the Tenant’s responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning the hot-tub & sauna (the Spa Facilities). Tenant agrees to have a responsible adult supervising minors while they are using the Spa Facilities. Minors should not use the sauna. The Tenant is hereby notified that the Spa Facilities can be dangerous and the Tenant accepts fully the risks involved.
  22. The Tenant is advised that the Property contains a gas stove and cooktop, gas heating, gas grill, and other gas-powered items and will seek help from the Landlord if the proper operation of such items is not fully understood.
  23. The Property has a fire extinguisher installed near the kitchen area & exit points. It is the duty of the Tenant to inform the Landlord immediately should the fire extinguisher become less than fully charged. The Tenant agrees to use the fire extinguisher only for true emergencies and to pay for the replacement of the fire extinguishers if they are discharged unnecessarily.
  24. The Property has fire alarms & carbon monoxide alarms installed and they are tested regularly according to fire department regulations. Tennant will notify the Landlord, without delay, if a fire alarm “chirps” or the Tenant is concerned they may need maintenance.
  25. The Tenant shall see to their own security while in the Property by locking doors, windows, garage doors, etc. when it’s prudent to do so. The Landlord is not responsible for loss of the Tenants Property.
  26. We occasionally experience outages that are beyond our control. The Tenant will report outages to the Landlord as soon as possible, so the Landlord can contact the appropriate authorities. No refunds or compensation will be given for any outages.
  27. The Landlord provides basic supplies such as towels, linens, cups, knives, forks, spoons, dishes, toilet paper, soap, dish detergent, laundry soap, shampoos for use by the Tenant at no charge. No reimbursement will be made for supplies purchased by the Tenant.
  28. Valuable items left behind by the Tenant or the Tenants Guests will be held for the Tenant for up to 1 month, after which they shall become the Property of the Landlord. The Landlord shall not be held liable for the condition of said items. The Tenant is responsible for any cost associated with the storage or return of said items.
  29. The Tenant agrees that there shall be no smoking within 3 meters of any structure on the Property.
  30. The Tenant agrees that there shall be no animals or pets of any kind will be brought onto the Property.
  31. The Tenant agrees that there shall be no hot-tub or fire-pit usage from 10 PM to 8 AM each night.
  32. Only legally owned and permitted firearms shall be allowed on the Property according to federal, provincial and local laws.
  33. Tenant agrees that fireworks and other hazardous materials shall not be used on the Property.
  34. The Tenant will not allow shoes to be worn inside the house, with the exception of the tiled entryway.
  35. The Tenant will not allow any litter to be left around the Property, inside or outside.
  36. The Tenant will not allow any sound equipment (e.g. speakers, DJ turntables or amplification devices) to be brought onto the Property. The Tenant will not permit music to be played outside on the Property.
  37. The Tenant agrees to sort all waste material generated during the rental period into the designated recycling boxes and bins - a recycling guide is provided. At the end of the stay, the Tenant will take all recycling and garbage to the garage and ensure it is correctly sorted. A charge may apply if the recycling is not correctly sorted.
  38. The phone is for local calls only. Emergency medical and police service can be called by dialing 911.
  39. The Tenant agrees not to access the housekeeping storage closet(s), even if unlocked, which contains cleaning supplies and chemicals that could be hazardous to children and adults.
  40. Cable TV is provided and service level has been chosen by the Landlord. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to cable TV service. The Tenant agrees to reimburse the Landlord for any pay-per-view services they access during their stay. High speed wireless internet & cable TV are provided as a convenience only and are not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to internet service.
  41. The Tenant agrees to pay the following fines per night (+ 5% GST), on top of the cost of repair, for the following violations:
$2,000 - Unauthorized events at the house, or greater than 16 persons on the Property at any time
$2,000 - Violation of the quiet hours (10 PM to 8 AM) resulting in a neighbour/community complaint
$500 - Animals &/or pets in the house
$500 - Smoking in the house
$500 - Illegal substances in the house
$350 - Causing the hot-tub to require a drain, clean and re-fill (e.g. foreign materials or substances)
$100 - Non-emergency calls made to the Landlord after 9pm or before 8am
$200 - Additional cleaning required upon check-out (house is dirty beyond normal expectations)
$85 - Not following the hot-tub & sauna rules (e.g. leaving lid off hot tub)
$85 - Shoes worn inside the house (beyond the tiled entry area)
$85 – Bikes, skis or other large sporting equipment brought inside the house
$85 - Sound equipment brought onto the Property (e.g. DJ equipment, portable speakers)
$85 - Leaving fire-pit lit unsupervised or failing to turn the gas valve off after use
$85 - Leaving doors or windows open when not at the Property
$85 - Leaving litter or cigarette butts outside or around the Property
$85 - Leaving food or food-like substances outside or around the Property
$85 - Moving furniture (unless agreed in advance)
$85 - Allowing members of the group to park on street
$85 - Camping or RVs on the Property
$85 - Sub-leasing the Property (unless agreed in advance)
$85 - Violating the check-in or check-out times (unless agreed in advance)
$85 - Not sorting the recycling, or carrying it down to the garage
 
Fines are independent of and additional to any Damage Deposit amount but may be taken from the Damage Deposit at the discretion of the Landlord.
 
The Landlord will always endeavour to communicate with the Tenant, verbally or in writing, before a fine is issued to give the Tenant the opportunity to cease the violation &/or tidy up to avoid the fine.

If the Tenant does not cease the violation &/or tidy up, deductions may be taken from the damage deposit & notice of the immediate end of the Rental Period may be given.
